Mr. DiCalro was stuck with a huge hospital bill that would have been significantly less had he been insured. Unfortunately, his attempt to have the court apply a more reasonable price was unsuccessful. This comment re-examines the case of DiCarlo v. St. Mary’s Hospital under the contract theories of open price term and unconscionability. It explores different avenues of interpretation the court could have applied to his cause of action. In the end, this comment offers legislative recommendations on how to address the problem of hospitals overbilling the uninsured.

Genetically Engineered Animals Approved For Food Chain

On Thursday January 15, 2009, the FDA announced formal guidelines for the regulation of genetically engineered animals. These guides are intended to regulate the safety and efficacy of genetically engineered animals through requirements such as extensive scientific testing before the products enter the market. Once these meats have been approved to enter into the market, the FDA will not require any labeling that would alert consumers of any genetic engineering. According to a poll by Consumers Union, 95% of consumers prefer labels informing them whether a product has been genetically altered. Groups are now turning to the forthcoming Obama administration to reverse the guidelines and require that genetically engineered products be labeled.
